Pokefi App User Agreement

The terms "you" and "your" refer to any visitor (“visitor”) at www.mypokefi.com (“the Site”), any user (“App user”) of the Pokefi App (“the App”), as well as to any customer (“customer”) who engages in transactions over the Site and the App (if we include such features). The terms "SMARTGO", "we" and "us" refer to SmartGo Worldwide Inc.

Please read these terms and conditions carefully as they apply to your use of the Site or the App, and you agree to be bound by these terms and conditions.
Registration
- You may be required to register with us in order to access certain functions (“Post Log-in functions”) of the App/Site. Where you are required to register:
  - You must provide us with accurate, complete and updated registration information;
  - You must safeguard any user name and password which we provide to you; and you authorize us to assume that any person using the App/Site with your user name and password is either you or is authorized to act for you.
- You acknowledge that your use of the post log-in functions may be governed by additional terms and conditions. Where this is the case, you will be notified accordingly, and those additional terms and conditions:
  - will apply to your use of such post log-in functions in addition to these terms and conditions; and
  - will prevail over these terms and conditions to the extent of any inconsistency.
Provision of Functions
- You acknowledge that we may, in our sole discretion and with or without notice,
  - vary the App/Site or any part of the App/Site; and
  - modify or discontinue this App, any part of the App and the features available on it
Intellectual Property Rights
- You acknowledge that content on the App/Site is subject to copyright and possibly other intellectual property rights. Unless you are expressly authorised by law, you must not yourself, or participate in or permit any other person, to:
  - sell, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on; or
  - repost or otherwise use any of the content in any way for any public or commercial purpose without our prior written consent; or use any content on any other Website or in a networked computer environment for any purpose; or
  - reverse engineer any content consisting of downloadable software; or otherwise infringe the Intellectual Property Rights of any person in using the App/Site or any content.
- Nothing you do on or in relation to the App/Site will transfer any Intellectual Property Rights to you or license you to exercise any Intellectual Property Rights unless this is expressly stated.

Personal Data
- In using the App/Site, you give us "personal data" during the registration process. The personal data includes but is not limited to your name and contact information. We manage your personal data according to our Privacy Policy - https://www.mypokefi.com/privacy-policy.
- By using this App, you grant us the consent to use your personal data in accordance with our Privacy Policy.
- Through the App/Site, you can create, review and modify your personal data. You are solely responsible for the security of any data stored on your mobile device. We will not be liable for any damage, loss or leakage of data resulting from the use of this Service.

- We may record your visit to this App/Site for analysing the number of visitors to this App/Site, general usage patterns and your personal usage patterns. This App/Site is provided on an “As-is” and “As Available” basis without any express or impliedly warranty as to the accuracy, reliability, security, timeliness, fitness for particular purposes of non-infringement in relation to the contents of this App/Site. We will not be liable for any errors or omissions concerning any information provided by the App, and will not accept any liability for any loss or damage arising from any use or reliance on the information delivered by this App/Site or inability to use this App/Site. You understand and agree to use this App/Site at your sole risk.
This App can be accessed on most models of mobile devices. You may check the compatibility of your mobile device before using this App.
Data charges apply to the connected Pokefi hotspot when using this App.
We may change these terms and conditions at any time with or without notice. All matters and disputes will be subject to our final decision.
